AI‑generated victim’s video forces Arizona killer to be resentenced

An Arizona man shot dead in a road‑rage incident will be resentenced after an appeals court found that an AI‑generated video of his victim was improperly shown in court.

Gabriel Paul Horcasitas was convicted in 2021 of shooting 37‑year‑old Christopher Pelkey at a red light. He received a 10‑year prison sentence.

His defense argued that the trial judge should not have admitted an AI‑recreated video produced by Pelkey’s family. The court agreed and ruled that the clip crossed a line, requiring a new sentencing hearing.

The AI video was built from voice recordings, photos and videos of Pelkey, and portrayed him speaking forgiveness. The judge initially praised the technology, but the appellate court deemed it an improper depiction of the victim.
