In brief

This request is part of ongoing legal battles over immigration enforcement and due process rights under U.S. law.

The Trump administration has recently moved to block a lower court’s decision that mandates due process for a group of Venezuelan immigrants who were deported to El Salvador without hearings. This emergency request, submitted to the U.S. Court of Appeals for the District of Columbia, comes just a day before the administration was due to present its plan on how to enable approximately 140 deported individuals to contest their expulsion. The controversial deportations took place on March 15 and utilized the Alien Enemies Act, a law from the 18th century that permits action against certain individuals during wartime or an invasion. The Venezuelan deportees, accused of ties to the violent gang Tren de Aragua, are currently detained in a high-security prison in El Salvador, specifically at the Terrorism Confinement Center (CECOT).Numerous court battles have unfolded as judges and the administration clash over immigration enforcement, with courts emphasizing that deported individuals are entitled to fundamental due process. Federal District Court Judge James E. Boasberg, who oversaw significant aspects of this case, challenged the administration’s actions regarding the deportations. He sought to halt the flights just after takeoff but the administration continued the process. In a recent ruling, Judge Boasberg ordered the administration to provide the deported individuals the due process they were denied, leaving the means by which this would occur up to the White House. The ongoing struggle reflects broader tensions surrounding immigration policy and the legal parameters of enforcement activities undertaken by the Trump administration.
