Canadian Tourist Sentenced After Stealing Flamingo from Las Vegas Hotel
In early March, Mitchell Fairbarn, a 34‑year‑old Canadian, stole a Chilean flamingo named Peachy from the Flamingo Las Vegas Hotel & Casino, carrying it through a hotel lobby, up an elevator and into his room, all while heavily intoxicated. Video footage shown at trial caught the visitor smiling as he lifted the bird by the neck, a sight that has become the centerpiece of the case.
Fairbarn admitted he had consumed 30 to 40 beers before the incident and claimed he never intended to harm the bird. He faces up to nearly five years in prison on felony and misdemeanor animal‑abuse charges.
Veterinary witnesses testified that Peachy suffered torn feathers and blood loss during the abduction. A state veterinarian later reported that Peachy has largely recovered physically but appears more anxious around humans.
Representing Fairbarn, lawyer Josh Tomsheck dismissed the act as a “harmless prank” and blamed the defendant’s heavy drinking. “He should not have gone into the habitat, shouldn’t have touched a bird, shouldn’t have taken Peachy inside,” Tomsheck told the court, adding that the client had faced death threats since his arrest.
During the jury’s deliberation, 14 witnesses were questioned and 112 pieces of evidence were reviewed. The jury took roughly five hours to convict Fairbarn on all charges.
Fairbarn remains under house arrest in Las Vegas and cannot leave the United States, with a sentencing hearing set for December.
The Flamingo Las Vegas, situated on the Strip, boasts a free‑to‑walk wildlife habitat that hosts a flock of Chilean flamingos, other birds, fish and turtles. The incident has prompted calls for tighter visitor security and greater awareness of animal welfare among hotel guests.
