In brief

The dismissal ends a decade-long legal battle that inspired similar lawsuits, despite the plaintiffs’ claims of violated constitutional rights by fossil fuel policies.

The U.S. Supreme Court announced on March 24, 2025, that it will not hear an appeal in the landmark climate case known as Juliana v. United States, effectively concluding a decade-long legal battle initiated by 21 young activists against the federal government over climate change policies. This decision comes despite the plaintiffs’ arguments that the government's endorsement of fossil fuels infringed upon their constitutional rights to a stable climate and environment. The case, which has been closely followed by environmental advocates, was dismissed by the United States Court of Appeals for the Ninth Circuit two years earlier. In its ruling, the appellate court predominantly reasoned that tackling climate issues is a matter for the political branches of government rather than the judiciary system.Judge Andrew D. Hurwitz articulated in his 2020 opinion that while the plaintiffs presented a compelling case for intervention, the resolution of their grievances lies outside the purview of the courts. Following this ruling, Our Children’s Trust, the nonprofit organization representing the plaintiffs, made a final attempt last year to have the Supreme Court overturn the Ninth Circuit’s decision, but that petition has now been rejected as well. Some observers indicated that bringing the case before a conservative Supreme Court could have posed risks. Concerns were raised that the Court might leverage this case to overturn established environmental protections rather than reinforce them. While the Juliana case itself will not proceed further in the courts, its influence has already sparked a wave of climate-related lawsuits that have shown more promise in achieving legal victories, carrying forward the fight for climate justice on behalf of younger generations.
